Terms of Service

1. Introduction and Scope

These Terms of Service (“Terms”) govern your use of VersaTale, an AI-powered interactive storytelling application (“the Service”), operated by Jannis Kilian, Perhamerstr. 82, 80687 München (“we”, “us”, “the Operator”).

By creating an account or using VersaTale, you agree to these Terms. If you do not agree, you may not use the Service.

VersaTale is available through the Apple App Store and Google Play Store. Your use of those platforms is additionally governed by the respective store’s terms of service.

2. Service Description

VersaTale is an AI-powered interactive storytelling service. The Service uses third-party artificial intelligence models to generate personalized, choice-driven narrative experiences. Each story is dynamically generated based on your inputs and choices. Details about the specific AI providers we use are available in our Privacy Policy.

Because stories are produced by AI models, the quality, coherence, and content of generated stories may vary. We do not guarantee any particular outcome, accuracy, or quality level of AI-generated content. AI-generated text and images may occasionally produce unexpected, inconsistent, or nonsensical results.

3. Eligibility and Account

3.1 Age Requirement

You must be at least 16 years of age to create an account and use VersaTale. By creating an account, you confirm that you are 16 or older.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorized use of your account.

3.3 One Account per User

Each user may maintain only one account. We reserve the right to suspend or terminate duplicate accounts.

4. Credits and Subscriptions

4.1 Service Credits

VersaTale uses a credit-based system to meter access to its AI generation service. Credits are consumed when the Service generates story content on your behalf.

Credits:

  • represent prepaid access to the Service — they are not a virtual currency, digital good, or stored-value instrument;
  • have no monetary or cash value;
  • are non-transferable between users;
  • cannot be exchanged, traded, sold, or redeemed for cash or any other consideration;
  • are personal to your account and cannot be gifted or assigned.

4.2 Subscriptions

VersaTale offers subscription plans that provide a recurring allocation of credits. Subscriptions are open-ended and automatically renew at the end of each billing period until you cancel.

4.3 Credit Rollover

Unused credits roll over to subsequent billing periods without expiration. Credits do not expire, regardless of whether your subscription is active or cancelled.

4.4 Cancellation

You may cancel your subscription at any time through the Apple App Store or Google Play Store. Upon cancellation:

  • No further billing periods will be charged.
  • Your subscription benefits (including access to any remaining credits) continue until the end of the current, already-paid billing period.
  • After the current billing period ends, your remaining credits stay in your account and can be used at any time. No new credits will be allocated until you resubscribe.

4.5 Purchases and Billing

All purchases are processed through the Apple App Store or Google Play Store. The respective store acts as the merchant of record and handles payment processing, billing, receipts, and applicable taxes (including VAT). The store’s own terms and refund policies apply to all transactions.

Prices are displayed within the app at the point of purchase and may vary by region.

4.6 One-Time Sign-Up Bonus

New users receive a one-time credit bonus upon account creation, at our discretion. This bonus is subject to the same conditions as subscription credits. We reserve the right to modify or discontinue the sign-up bonus at any time.

5. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days of its conclusion, without giving any reason.

5.1 Exercising Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by contacting us at hello@versatale.app with a clear statement (for example, a letter or email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

5.2 Effects of Withdrawal

If you withdraw from a contract, we will reimburse you for all payments received from you without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment you used for the initial transaction.

If you have requested that performance of the Service begin during the withdrawal period, you shall pay us an amount proportional to the services provided up to the point at which you informed us of your withdrawal, in comparison with the full coverage of the contract.

5.3 Practical Note on Refunds

Since all purchases are processed through the Apple App Store or Google Play Store, refund requests are handled by the respective store in accordance with their policies and applicable law. You may submit refund requests directly through the store.

6. AI-Generated Content

6.1 Nature of Content

All story text, images, and other creative content generated through VersaTale are produced by third-party AI models. We do not manually author, review, or curate individual story outputs.

6.2 Content Ownership and License

Your inputs (choices, prompts, settings) remain yours. AI-generated content (story text, images, scene descriptions) produced by the Service is owned by the Operator. We grant you a non-exclusive, non-transferable, royalty-free license to use, display, and share AI-generated content, including on monetized platforms and social media channels. This license covers personal enjoyment, sharing stories and story-related content (such as screenshots, excerpts, and share cards), and incorporating AI-generated content into your own creative or commercial work (such as videos, blog posts, or streams).

You may not resell, sublicense, or redistribute AI-generated content as a standalone product or dataset, or use it to build a competing service.

6.3 No Guarantees

We do not guarantee that AI-generated content will be accurate, coherent, complete, appropriate, or free from errors or biases. AI models may produce content that is repetitive, inconsistent, or unexpected. The Service is provided for entertainment purposes.

6.4 AI Data Processing

Your inputs are processed by third-party AI providers to generate content. These providers have their own terms of service and data processing practices. Please refer to our Privacy Policy for details on which providers are used and how your data is handled.

7. Acceptable Use

You agree not to:

  • Attempt to manipulate, override, or bypass the AI system’s instructions, safety measures, or content guidelines (including prompt injection or jailbreaking attempts);
  • Use the Service to generate content that is illegal, hateful, threatening, harassing, defamatory, obscene, or that promotes violence or discrimination;
  • Use the Service in any way that violates applicable laws or regulations;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Use automated scripts, bots, or similar tools to access the Service;
  • Share your account credentials with others or allow others to use your account;
  • Attempt to circumvent the credit system, exploit bugs, or abuse promotional offers.

We reserve the right to suspend or terminate your account if you violate these terms. The Service employs technical content safety measures in addition to the contractual restrictions above.

7.1 User Inputs

Your story prompts, choices, and settings are transmitted to third-party AI providers for content generation. While AI providers apply their own content safety filters, you are responsible for the prompts and inputs you provide. We reserve the right to review usage patterns and take action (including account suspension) if inputs are designed to circumvent content safety measures or generate prohibited content.

8. Intellectual Property

The VersaTale name, logo, design, software, and all associated intellectual property are owned by the Operator. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology beyond the limited license to use the Service as described herein.

9. Modifications

9.1 Changes to the Service

We may modify, update, or discontinue features of the Service at any time. If changes materially affect your use of the Service, we will provide reasonable notice (for example, via in-app notification or email).

9.2 Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days before they take effect via email to the address associated with your account and/or via in-app notification. The updated Terms will indicate the date of the most recent revision.

Your continued use of the Service after the updated Terms take effect constitutes acceptance. If you do not agree to the changes, you may stop using the Service and cancel your subscription before the changes take effect.

10. Liability

10.1 Unlimited Liability

We bear unlimited liability for damages caused by intent or gross negligence, for injury to life, body, or health, and for claims under mandatory product liability law. These statutory obligations are not affected or limited by any other provision of these Terms.

10.2 Liability for Slight Negligence

In cases of slight negligence, we are liable only for breaches of essential contractual obligations — that is, obligations whose fulfillment is fundamental to the proper performance of the contract and on which you may reasonably rely. In such cases, liability is limited to foreseeable damages typical for this type of contract.

10.3 Liability Cap

Where our liability is not unlimited under Section 10.1, our total aggregate liability arising from or related to these Terms and your use of the Service is limited to the total amount of fees you have paid to us (through the respective app store) during the 12 months immediately preceding the event giving rise to the claim, or EUR 50, whichever is greater.

10.4 Exclusion of Consequential Damages

To the extent permitted by applicable law and except in cases of unlimited liability under Section 10.1, we are not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, loss of profits, loss of enjoyment, or damages arising from reliance on AI-generated content.

10.5 Third-Party Services

VersaTale relies on third-party services including AI providers (Google, OpenAI), cloud infrastructure (Supabase), and app store platforms (Apple, Google). We are not liable for outages, errors, content filtering decisions, or policy changes by these third-party providers that may affect the Service or your experience, except where mandatory liability under Section 10.1 applies.

10.6 AI-Generated Content

We are not liable for any decisions, actions, or consequences arising from AI-generated content. Story content is fictional and generated for entertainment purposes. It should not be relied upon for factual information, advice, or guidance of any kind. This disclaimer does not limit our liability under Sections 10.1 and 10.2.

10.7 Service Availability

We do not warrant uninterrupted or error-free operation of the Service. We are not liable for temporary unavailability due to maintenance, updates, technical failures, or circumstances beyond our reasonable control, except where mandatory liability under Section 10.1 applies.

11. Account Termination

11.1 By You

You may delete your account at any time through the app’s settings. Account deletion will result in the permanent loss of your stories, credits, and all associated data, in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service entirely. If we terminate your account without cause, we will provide reasonable notice.

11.3 Effect of Termination

Upon termination, your license to use the Service ends. Sections of these Terms that by their nature should survive termination (including liability limitations, intellectual property, and governing law) will remain in effect.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer in the EU, you additionally benefit from any mandatory protections provided by the law of your country of residence.

12.2 Consumer Dispute Resolution

We are not obligated and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board, but we may choose to do so on a case-by-case basis.

13. Additional Terms for Apple App Store Users

This Section 13 applies only if you obtained VersaTale through the Apple App Store. In the event of any conflict between this Section 13 and the other provisions of these Terms, this Section 13 prevails with respect to your use of the App Store version of VersaTale.

13.1 Relationship with Apple

These Terms are concluded between you and the Operator only, and not with Apple Inc. (“Apple”). The Operator, not Apple, is solely responsible for VersaTale and its content. Apple has no obligation whatsoever to provide any maintenance or support services with respect to VersaTale.

13.2 Scope of License

The Operator grants you a non-transferable license to use VersaTale on any Apple-branded device that you own or control, subject to the Usage Rules set out in the Apple Media Services Terms and Conditions. VersaTale may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where permitted by Apple.

13.3 Maintenance and Support

The Operator is solely responsible for providing any maintenance and support services with respect to VersaTale, as described in these Terms or as required under applicable law. You and the Operator acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to VersaTale.

13.4 Warranty

The Operator is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of VersaTale to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of VersaTale to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to VersaTale. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Operator.

13.5 Product Claims

The Operator, not Apple, is responsible for addressing any claims by you or any third party relating to VersaTale or your possession or use of VersaTale, including but not limited to: (i) product liability claims; (ii) any claim that VersaTale fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit the Operator’s liability to you beyond what is permitted by applicable law.

13.6 Intellectual Property Rights

In the event of any third-party claim that VersaTale or your possession and use of VersaTale infringes that third party’s intellectual property rights, the Operator, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

13.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.8 Third-Party Terms

You must comply with any applicable third-party terms of agreement when using VersaTale (for example, the terms of your wireless data service provider).

13.9 Apple as Third-Party Beneficiary

You and the Operator acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
